- Make payments in accordance with agreed schedules.
11. Payment Terms
- Fees for services will be agreed upon in advance and outlined in individual contracts.
- Payment must be made in full as per the agreed terms. Delays in payment may result in service suspension.
- For ongoing services (e.g., monthly social media management), payments are due on the first of every month unless stated otherwise in your agreement.
- All payments are non-refundable unless otherwise stated in the contract.
12. Intellectual Property Rights
All materials we create for your project, including but not limited to graphics, text, and media, remain the intellectual property of AFTERHOURS® until full payment is received. Upon full payment, ownership of these materials will be transferred to the client, except for third-party assets such as licensed stock images or fonts, which remain the property of their respective owners.
13. Limitation of Liability
While we strive to deliver high-quality services, we are not liable for any indirect, incidental, or consequential damages, including loss of revenue or business opportunities, arising from the use of our services. Our liability is limited to the amount paid for our services.
14. Revisions and Adjustments
- AFTERHOURS® offers up to two rounds of revisions for each project deliverable unless otherwise specified in the service agreement.
- Any additional revisions beyond the agreed scope will be subject to additional fees, which will be discussed before any extra work is initiated.
15. Confidentiality
We respect the confidentiality of all client-provided information. We will not disclose any information shared with us during the course of our work, except where required by law or with explicit consent from the client. Our mutual non-disclosure agreements (NDAs) apply where appropriate.
16. Termination and Cancellation
- Either party may terminate the agreement with a 30-day written notice. Upon termination, the client will be responsible for paying any outstanding invoices for work completed up to the date of termination.
- We reserve the right to terminate the agreement immediately if there is a breach of these terms, including failure to provide timely payments or misuse of delivered materials.
17. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA. Any disputes will be resolved in the courts located in Wyoming.
18. Amendments
We may revise these Terms from time to time. The revised Terms will be effective upon posting on our website. Continued use of our services after changes indicates your acceptance of the new Terms.
